Refund Policy
Digital Motorsports Club (DMC)

This Refund Policy forms part of the DMC Terms of Service and should be read together with the Sporting Regulations. It applies to entry fees for competitions organised by DMC and to subscriptions to the Digital Endurance App.
1. Your statutory rights
Nothing in this policy limits or excludes any right you have under Dutch or European Union consumer law. Where anything in this policy conflicts with a right the law gives you, the law prevails.
2. The 14-day right of withdrawal, and why it does not apply to a race entry
For most things bought online, European law gives consumers 14 days to change their mind. There is a specific exception for services relating to leisure activities that take place on a set date or during a set period — Article 16(l) of Directive 2011/83/EU, implemented in Dutch law in Book 6 of the Civil Code.
A championship entry falls within that exception. When you enter, you are buying a place on the grid for a season whose calendar is published in advance, at circuits and on dates that are fixed, with a limited number of places. You therefore do not have a 14-day right of withdrawal from a season entry, and we tell you this before you pay rather than afterwards.
This exception applies to entry fees. It does not apply to subscriptions to the Digital Endurance App, which are handled under section 7.
3. When we will not refund an entry fee
A grid place is allocated to you as soon as your payment is confirmed, and the costs of running the season are committed at its start. We will not refund an entry fee where:
3.1 Your team withdraws its own entry, at any point after payment is confirmed.
3.2 Your entry is disqualified, or a driver is banned, under the Sporting Regulations or the Terms of Service.
3.2a We withdraw your entry because your team has breached the Sporting Regulations or the Terms of Service, or because the entry fee was not paid.
3.3 You cannot take part because of something on your side — your internet connection, your computer, your hardware, a power cut, or your own installation of the game.
3.4 You cannot take part because your team did not have enough registered drivers.
3.5 An individual race is cancelled, rescheduled or shortened, but the season continues. Championship points are awarded in accordance with the Sporting Regulations.
3.6 The game itself malfunctions, or a session is affected by a fault in Le Mans Ultimate or in third-party infrastructure. Where a race cannot be completed, the Sporting Regulations govern how points are awarded.
3.7 You disagree with a sporting decision, a penalty, or the outcome of an appeal.
4. When we will refund an entry fee
4.1 We cancel a season before its first race. You receive a full refund of the entry fee.
4.2 We cancel a season after it has started. You receive a refund proportionate to the races that will not take place. If a season of eight rounds is abandoned after two have been completed, six eighths of the entry fee is refunded. Championship points for completed races stand.
4.3 We postpone the start of a season by more than 30 days from the date published when you entered. You may cancel your entry and receive a full refund. You are not obliged to — if you are happy to wait, your entry stands.
4.4 We cancel a standalone event before it takes place. You receive a full refund.
4.5 We decline your entry after taking payment. You receive a full refund. Where we decline an application before taking payment, no fee is charged and no refund arises.
4.5a We withdraw your entry for our own reasons, rather than because of anything your team has done — for example a change to the grid, the class structure or the calendar. You receive a refund proportionate to the races you will not take part in, calculated as in 4.2.
4.6 Refunds are made to the payment method you used, through our payment provider, within 14 days of us accepting that a refund is due.
5. Postponing rather than cancelling
We may postpone or reschedule a season or an event to secure a viable grid or for operational reasons. Where we do, your entry carries over and no refund arises, subject to your right under 4.3 where the delay exceeds 30 days.
6. Payment disputes
If you believe you are entitled to a refund, please contact us first. We would rather resolve it directly, and we will respond to any refund request within 14 days.
You retain every right you have with your bank or card provider, and using those rights is not a breach of these terms. We would simply ask that you raise the matter with us first, because a dispute raised with a bank costs us time and a fee that a direct conversation does not.
7. Digital Endurance App subscriptions
7.1 Subscriptions are billed monthly and may be cancelled at any time with effect from the end of the current billing period. Access continues until then.
7.2 We do not refund part of a billing period that has already begun, except where required by law or where we have failed to provide the service.
7.3 Where we discontinue the service, or materially reduce it, during a period you have paid for, you receive a proportionate refund.
8. How to request a refund
Email [email protected] with your team name, the season or event concerned, and the reason for your request. We will respond within 14 days.
9. Complaints
If you are not satisfied with our response, you may contact the Dutch Authority for Consumers and Markets (Autoriteit Consument & Markt), or use the European Commission's online dispute resolution platform where it applies to your purchase.
10. Changes to this policy
We may amend this policy. The version in force when you paid is the version that applies to that payment.
